INJURED FOR CHRISTMAS


It's that time of year again. When everyone treks through the stores and malls. Looking high and low for that perfect gift. And while you search the shelves, know this busy holiday season is the absolute worst for severe store slip and fall injuries.

Merchants know holiday shopping must put them in the black just to survive. Extra stock is stacked on pallets in the aisles. Shelves are overflowing. If it's in the building, it's in the aisles so shoppers can grab it and max out those cards. But wet winter floors don't mix well with narrow aisles crowded with wooden pallets. Slips, trips and dangerous falls happen when seasonal shoppers get caught unaware.

All businesses that invite you onto their property have a duty to keep that property reasonably safe. It makes no difference if it's a big box store, warehouse grocery store or your locally owned Mom and Pop shop, all shoppers are entitled to a reasonable expectation of safety when they step into that store. When you fall and suffer serious injuries, that business, property owner and any maintenance company may be held responsible for your injuries.

That store owner or franchise operator may not actually own the property. The true property or commercial real estate owner may also be liable for your injury and loss. A store may have a maintenance company helping them keep the floors clean or the parking lot free of ice and snow. That maintenance company may also be responsible for your injury. There may be at least three or more companies liable for your loss.

What are the usual offenders Martin Law sees every year?
